Article 1 | Scope and Amendments of General Terms and Conditions

💡 What it means
These are the rules for using Homevested’s services. By booking with us, you accept these terms and Spanish law. If we change them, we’ll notify you by e-mail; continued use means you agree.

1.1 These GTC govern the services provided by Homevested S.L. (“Homevested”, “we”, “us”), a company based in Valencia, Spain.

1.2 Definitions

  • Accommodation: Any room, flat, or property managed and listed via Homevested.
  • Tenant: A User who books and rents Accommodation.
  • Landlord: A property owner who has engaged Homevested to manage and rent out Accommodation.
  • Agency Fee: A non-refundable service fee payable by the Tenant to Homevested to reserve the Accommodation. This fee includes applicable VAT and covers administrative and management services.

1.3 By booking with Homevested, the User accepts these GTC.

1.4 Users must comply with all applicable Spanish rental laws and regulations.

1.5 Homevested may amend these GTC. Users will be notified at least 7 calendar days before changes take effect.

Article 2 | Services Provided by Homevested

💡 What it means
We are the managers of the properties. We handle bookings, contracts, check-ins/outs, and communication during your stay.

2.1 Homevested provides property management services on behalf of Landlords. We do not own the properties but act as the main contact for Tenants during their tenancy.

2.2 We handle:

  • Reservation and booking administration.
  • Drafting and exchange of lease contracts.
  • Organising check-ins and check-outs.
  • Acting as the Tenant’s primary point of contact for issues, repairs, and communication with the Landlord.

2.3 The lease contract is concluded between Tenant and Landlord. Homevested signs on behalf of the Landlord where authorised.

Article 3 | Agency Fee

💡 What it means
You pay us an agency fee to secure the booking. This fee is non-refundable — except if the Landlord cancels.

3.1 To reserve Accommodation, the Tenant must pay the Agency Fee (plus VAT) to Homevested.

3.2 The fee covers:

  • Administrative handling of the booking,
  • Preparation of the lease contract,
  • Management services during the tenancy.

3.3 The Agency Fee is non-refundable, except in the following case:

  • If the Landlord withdraws/cancels the booking before the start of the lease, Homevested will refund the Agency Fee in full to the Tenant.

3.4 In all other cases (e.g. Tenant cancellation, failure to sign contract, or no-show), the Agency Fee remains non-refundable.

Article 4 | Booking, Check-In and Check-Out Procedure

💡 What it means
How the booking process works and when you can move in or out.

4.1 A booking is confirmed when:

  1. The Tenant pays the Agency Fee.
  2. Homevested verifies the booking.
  3. Homevested sends the lease contract to Tenant and Landlord for signature.

4.2 After both parties sign, the Tenant must transfer the first month’s rent and deposit directly to the Landlord as per contract instructions.

4.3 Check-in and check-out times:

  • Standard hours: Monday to Friday, 09:00 – 18:00 (free).
  • Outside hours: Monday to Friday, 18:00 – 22:00 (subject to a €50 surcharge).
  • Weekends and public holidays: no check-ins or check-outs available.

4.4 Any exceptions must be confirmed in writing by Homevested.

Article 5 | Management and Communication

💡 What it means
During your stay, we are your main contact for everything.

5.1 Homevested acts as the primary point of contact for the Tenant throughout the tenancy.

5.2 We coordinate with the Landlord on:

  • Property maintenance and repairs,
  • Complaints and requests,
  • Deposit return at the end of the tenancy.

5.3 The Tenant agrees to address all tenancy-related communication through Homevested, not directly with the Landlord, unless otherwise agreed.

Article 6 | Liability

💡 What it means
We manage, but we are not the owners. We are not responsible for things outside our control.

6.1 Homevested is not the property owner. The Landlord remains legally responsible for providing the Accommodation in a habitable condition as required by Spanish law.

6.2 Homevested is responsible for providing management and administrative services with due care.

6.3 Homevested cannot be held liable for:

  • Actions or omissions of the Landlord,
  • Utility interruptions, unforeseen repairs, or issues beyond our control,
  • Disputes between Tenant and Landlord, except where caused by Homevested’s negligence.

Article 7 | Cancellation Policy

💡 What it means
You don’t get the Agency Fee back unless the Landlord cancels.

7.1 The Agency Fee is non-refundable, except if the Landlord cancels the booking before the start date of the lease. In this case, Homevested will refund the Agency Fee in full to the Tenant.

7.2 If the Tenant cancels or fails to proceed with the lease, the Agency Fee is lost.

7.3 Rent and deposit refunds are handled directly between Tenant and Landlord in accordance with Spanish rental law. Homevested may assist with communication but does not refund these amounts on behalf of Landlords.

Article 8 | Data Protection

💡 What it means
We comply with GDPR and Spanish data laws.

8.1 Homevested processes Tenant and Landlord data in accordance with the General Data Protection Regulation (GDPR) and Spanish data protection laws.

8.2 Data is used only for providing our services (contracts, communication, tenancy management).

Article 9 | Applicable Law and Jurisdiction

💡 What it means
Spanish law applies, and any disputes are handled in Valencia.

9.1 These GTC are governed exclusively by Spanish law.

9.2 Disputes shall be resolved by the courts of Valencia, Spain.

Article 10 | Severability Clause

If any provision of these GTC is invalid, the rest remains valid.
